Terms of Service

1. Agreement and Eligibility

These Terms are a legally binding agreement between you and Mondrus CCS Inc (“Mondrus”, “we”, “us”, or “our”) governing the Boletus Android application and related materials (the “App”).

You may use the App only if you are at least 18 years old, are legally capable of entering into this agreement, and may lawfully use the App where you live. If you use the App on behalf of an organization, you represent that you have authority to bind that organization.

2. What Boletus Does

Boletus is a local-first foraging journal and reference. It can record an outing, draw a GPS route, mark mushroom finds, attach photos and notes, show a mushroom catalogue, display online or downloaded maps, calculate personal statistics, export a route as GPX, and create or restore a user-directed ZIP backup.

The current App:

• does not create a Mondrus user account;
• does not upload your precise routes, find coordinates, notes, or photos to Mondrus;
• does not provide social sharing or public user content;
• may display advertising supplied by Google AdMob and advertising partners; and
• does not currently offer paid features or subscriptions.

The App uses online map services, Google Firebase Analytics and Remote Config, and may use Google AdMob as described in the Privacy Policy. The Android Advertising ID (AD_ID) may be used for advertising, attribution, and analytics.

3. Mushroom and Food Safety

The catalogue, names, illustrations, descriptions, seasons, habitats, look-alike information, and edibility labels are provided for general reference only. Fungi vary by age, location, condition, preparation, and individual sensitivity. Regional common names and taxonomy can change, and an illustration or short description cannot establish identity.

• The App does not identify a mushroom from a photograph or physical specimen.
• An “edible”, “choice”, “good”, or similar label is not advice to eat a mushroom.
• Cooking, boiling, drying, or other preparation instructions in descriptive material are not a safety guarantee.
• Toxic and deadly species may resemble edible species.
• You are solely responsible for identification, collection, preparation, possession, and consumption decisions.

Use qualified local experts and authoritative regional sources before handling or consuming wild fungi. When in doubt, leave the specimen untouched. Mondrus is not responsible for poisoning, allergic reaction, illness, injury, or death arising from reliance on App content.

4. Outdoor, Location, and Map Safety

GPS, compasses, mobile devices, downloaded maps, and online map data can be inaccurate, incomplete, delayed, unavailable, or affected by terrain, weather, battery level, satellite visibility, network coverage, and device settings. Recorded routes may contain gaps or incorrect points. A downloaded area may not include every path, hazard, property boundary, access restriction, or emergency feature.

Boletus is not an emergency, rescue, navigation, or personal-safety service. Do not rely on it as your only means of navigation. Carry suitable independent maps and safety equipment, tell someone your plans, observe weather and daylight, remain aware of your surroundings, and follow local access, conservation, protected-species, and foraging laws. Do not operate the App while driving or when doing so would be unsafe.

5. License

Subject to these Terms, Mondrus grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the App on devices you own or control for lawful, non-commercial purposes.

Except where applicable law expressly permits it, you may not:

• copy, modify, distribute, sell, rent, sublicense, or commercially exploit the App;
• reverse engineer, decompile, disassemble, or attempt to derive the App’s source code;
• remove proprietary notices or misrepresent the App’s origin;
• use automated means to overload, scrape, or interfere with the App or its providers;
• bypass security, technical limits, or access controls; or
• use the App in violation of law or another person’s rights.

6. Your Data, Content, and Backups

You retain ownership of the routes, finds, notes, photos, and files you create. You grant Mondrus no ownership interest in that content. Processing required to operate local App features occurs on your device; service-provider processing is described in the Privacy Policy.

You are responsible for:

• the accuracy and legality of information and photos you record;
• having the right to capture, store, export, and share your content;
• protecting your device, Google account, exported GPX files, and ZIP backups;
• choosing trustworthy export destinations and recipients; and
• keeping independent backups of information you do not want to lose.

Deleting the App, clearing its storage, losing or damaging a device, operating-system behaviour, storage failure, or a software defect may cause local data loss. Android Auto Backup and the App’s ZIP export are conveniences, not guarantees that data can always be restored.

7. Permissions and Device Requirements

Some features require location, foreground-service, notification, network, camera-application, or storage-sharing capabilities. You control runtime permissions in Android settings. Refusing or revoking a permission may make the related feature unavailable.

You are responsible for a compatible device, a supported Android version, sufficient storage and battery, network access when using online features, data charges, and keeping the device reasonably secure and updated.

8. Third-Party Services and Content

The App depends on or contains material from third parties, including:

• Google Play and Android for distribution, permissions, device services, file sharing, and optional system backup;
• Google Firebase Analytics, Installations, and Remote Config for product measurement, attribution, advertising measurement, audiences, and operational configuration;
• Google AdMob and advertising technology partners for selecting, personalizing where permitted, delivering, measuring, attributing, and securing advertising;
• OpenFreeMap for hosted map styles, vector tiles, and fonts;
• OpenMapTiles technology and map styling components; and
• OpenStreetMap contributors for underlying map data.

Third-party services are governed by their own terms, licenses, and privacy policies. We do not control their availability, accuracy, security, or changes. Map content is informational and may be outdated or incomplete. Attribution shown in the App must not be removed.

8.1 Advertising

The App may be supported by advertising. Ads may be personalized, non-personalized, limited, or contextual depending on your region, consent choices, device settings, and provider availability. Advertising providers may use the Android Advertising ID, Firebase and app identifiers, IP-derived approximate location, device and network information, consent signals, and ad interaction data as explained in the Privacy Policy.

Where required, the App will request consent before personalized advertising and provide access to relevant privacy options. Refusing personalized advertising does not necessarily remove advertising. We do not endorse or guarantee an advertiser, advertised product, or external destination. If you interact with an ad, the advertiser or destination service applies its own terms and privacy policy.

9. Updates, Remote Configuration, and Availability

We may release updates, correct data, add or remove features, change technical limits, replace a map endpoint, or modify operational settings through Firebase Remote Config. These changes may be necessary for reliability, safety, legal compliance, or provider availability.

We do not promise that the App or any online feature will always be available, uninterrupted, secure, compatible with every device, or preserved indefinitely. OpenFreeMap, Firebase, AdMob, advertising partners, Google Play services, network access, or device features may fail or be discontinued. We may suspend or discontinue the App or a feature where reasonably necessary.

10. Intellectual Property

The App’s original code, design, interface, text, illustrations, branding, and other Mondrus material are owned by or licensed to Mondrus and protected by applicable intellectual-property laws. “Boletus” and related branding may not be used in a way that suggests endorsement or affiliation without written permission.

Third-party libraries, map data, fonts, and other components remain subject to their respective licenses and attribution requirements.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP AND ALL CONTENT ARE PROVIDED “AS IS”, “AS AVAILABLE”, AND “WITH ALL FAULTS”. MONDRUS DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND QUIET ENJOYMENT.

WE DO NOT WARRANT THAT THE APP WILL IDENTIFY MUSHROOMS; DETERMINE EDIBILITY; PREVENT POISONING, INJURY, GETTING LOST, OR DATA LOSS; RECORD A COMPLETE OR ACCURATE ROUTE; RESTORE A BACKUP; OR OPERATE WITHOUT INTERRUPTION OR ERROR.

Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONDRUS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF DATA, CONTENT, PROFITS, REVENUE, OR OPPORTUNITY; POISONING, ILLNESS, PERSONAL INJURY, DEATH, PROPERTY DAMAGE, TRESPASS, FINES, OR RESCUE COSTS; OR DAMAGES ARISING FROM MAPS, LOCATION SERVICES, THIRD-PARTY SERVICES, OR YOUR RELIANCE ON APP CONTENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID TO MONDRUS FOR THE APP DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, or affects mandatory consumer rights available in your country.

13. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Mondrus and its officers, directors, employees, and agents from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful use of the App, violation of these Terms, violation of another person’s rights, or content you choose to export or share. This section does not apply where prohibited by applicable consumer law.

14. Suspension and Termination

You may stop using the App at any time and may terminate this agreement by uninstalling it. We may suspend online functionality or terminate your license if you materially violate these Terms, create security or legal risk, or misuse third-party infrastructure.

Upon termination, your license ends. Provisions that by their nature should survive—including ownership, disclaimers, limitations of liability, dispute terms, and general provisions—will survive. Uninstalling normally deletes local App data, subject to any separate Android backup in your Google account.

15. Governing Law and Disputes

15.1 Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules, except where mandatory law in your place of residence applies.

15.2 Informal resolution

Before starting formal proceedings, please email contact@garny.io with a description of the dispute and requested resolution. We will try to resolve it informally within 30 days.

15.3 Individual arbitration

Except where prohibited by law, an unresolved dispute will be resolved through binding individual arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules. To the extent permitted by law, claims must be brought individually and not as a plaintiff or class member in a class, collective, or representative action.

15.4 Mandatory local rights

If you reside in the European Economic Area, United Kingdom, or another jurisdiction whose law gives you a non-waivable right to bring a claim in local courts or use a consumer dispute body, nothing in this section removes that right.

16. Changes to These Terms

We may update these Terms when the App, providers, or law changes. We will post the revised Terms at this URL and change the “Last updated” date. Where required, we will provide additional notice. Continuing to use the App after revised Terms take effect means you accept them, to the extent permitted by law.

17. General

These Terms and the Privacy Policy are the entire agreement between you and Mondrus regarding the App. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, merger, acquisition, or sale. We are not liable for delay or failure caused by events beyond our reasonable control.

These Terms are written in English. A translation may be provided for convenience, but the English version controls unless applicable law requires otherwise.
